Divorce in Ontario

There are two main types of Divorce in Ontario:

  • Uncontested Divorce
  • Contested Divorce

An uncontested divorce is the most common type of divorce in Ontario. This type of divorce is when both spouses agree on all the issues. The spouse, which initiates the uncontested divorce will file an application with the Ontario Superior Court of Justice. They will also serve a copy of it to their spouse. Their spouse then has 30 days to file an ‘Answer’. If the answer is not filed, the court assumes that their spouse does not contest the divorce and causing the divorce to be uncontested. The court also requires that the applicant must file an Affidavit of Service. This means swearing that the respondent was served. For this part, a process server can be hired.

A contested divorce, on the other hand, is when the spouses disagree on some or all the issues. Some common disagreements in contested divorces include child custody, child support, spousal support, division of property and more. Contested divorce cases are usually more expensive than uncontested cases. It is recommended to hire a reputable family lawyer who are experienced and trustworthy. Family lawyers typically charge an hourly fee for contested cases. Most family lawyers offer a free initial consultation, so we recommend meeting a couple of lawyers to see who you feel most comfortable with.

An uncontested divorce is the most common way to get a divorce in Ontario. This type of divorce is also usually the cheapest. To get an uncontested divorce in Ontario, you can simply do everything yourself. You will need to fill out an application, submit that application to the courts, serve your spouse and pay the mandatory court fee.
